1. Booking Your booking is definite when a completed application form has been received by Travelinck. Clients booking by telephone will be deemed to have read and accepted the booking conditions and the booking is valid from the day the personal data is received by Travelinck. After receiving the application, Travelinck will confirm acceptance in writing. Travelinck reserves the right to decline any booking at their discretion.
2. Payment A deposit of € 350 should be paid within seven days of the confirmed acceptance by Travelinck and this is part of the trip price. If the client requires travel and/or cancellation insurance the costs are to be paid within seven days of issue. The balance of all monies due, including any surcharges, must be paid to Travelinck not later than ten weeks before departure. In the case of non-payment of the balance by the due date Travelinck may treat the booking as cancelled by the client.
3. Changing your Booking An administration fee of € 25 per booking plus any additional costs will be charged if a confirmed booking is changed or transferred prior to 57 days before departure. Thereafter, all changes will be treated as cancellations and subject to the charges below.
4. Cancelling your Booking Should the client wish to cancel, cancellation charges will be imposed. These are calculated from the day written notification is received by Travelinck as a percentage of the total tour price, including surcharges, as shown below, or the non-refundable deposit, whichever is greater.
a) Up to 57 days before departure, 25% of the trip price with a minimum of € 350
b) From the 56th to the 43rd day before departure 40% of the trip price
c) From the 42nd to the 29th day before departure 65% of the trip price
d) From the 28th to the 15th day before departure 85% of the trip price
e) From the 14th to the 8th day before departure 95% of the trip price
f) From the 7th day before departure 100% of the trip price
5. Travel and Cancellation Insurance Travel insurance is mandatory for all clients whilst on a tour organised by Travelinck. Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance and ensuring that they are in possession of private travel insurance with protection for the full duration of the tour in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment, with adequate benefits. Clients should ensure that there are no exclusion clauses limiting protection for the type of activities included in their tour. Cancellation insurance may be obtained directly from Travelinck. Travel insurance should be arranged independently. Whether insurance is issued by Travelinck or arranged independently, the clients must satisfy themselves that any such insurance is what they require and clients should arrange supplementary insurance if necessary.
6. Liability Insurance The client acknowledges and accepts that there may be no policy covering Travelinck’s liability to clients for death, injury, damage or loss occurring anywhere in the world. The client also specifically acknowledges that with respect to passenger liability cover this cover may be very limited or may not exist at all. The client must assume that he/she is not covered by any Travelinck insurance policy, including all liability insurance for death, injury, damage or any other loss.
7. Travel period and Travel Itinerary Apparent faults or mistakes are not binding. Changes will only be made in cases where there are legitimate reasons to do so. The accuracy of the execution of the itinerary is based on the habits and customs in the country concerned. Incidental or structural alterations in the services and flight schedules of the transportation companies may influence the travel period. Excepting those agreements covering travel and cancellation insurance made by the client, the client has no right to the repayment of a part of the tour price if the departure time differs for no more than 36 hours from the original departure time. Furthermore, Travelinck is not responsible for loss or damage resulting from delays, or any penalty charges associated with connecting airfares in the event of a change to a tour departure time, date, or cancellation.
9. Cancellation by Travelinck Travelinck reserves the right to cancel a tour in any circumstances but will not cancel a tour less than six weeks before departure except for force majeure, consolidation, or the client’s failure to pay the final balance. Unless the client fails to pay the final balance, Travelinck, upon cancellation, will refund all monies paid (minus the costs incurred for the organisation of the tour). Force majeure is war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, charges imposed by rescheduling or cancellation of flights by an airline or other similar events beyond the control of Travelinck. Consolidation refers to the fact that certain tours are dependent upon a minimum number of participants.
10. Responsibility of Travelinck Clients bookings are accepted on the understanding that they appreciate the possible risks inherent in travel and that they understand the tours featured in Travelinck’s programme at their own volition. Travelinck only acts as an agent for the owners, contractors, suppliers of transportation and local operators/agents, and/or other related travel services provided and assumes no liability or responsibility for additional expenses howsoever caused arising directly or indirectly from the actions or omissions of such independent parties, accidents, loss or damage to person or property, delays, transport failures, strikes, war, force majeure, Acts of God, etc., over which Travelinck has no control. Arrangements so made by Travelinck will be subject to any special terms imposed by the supplier of these services. Travelinck accepts no liability for any action or activity undertaken by the client arranged independently of Travelinck while on tour.
11. Tour price and surcharges The prices quoted are based on exchange rates current at the time of issuing the brochure. However, as external factors may affect exchange rates, air fares, transportation and accommodation, Travelinck reserves the right to alter the price of any tour and forward an amended invoice. Any price increase will normally be notified more than 6 weeks before departure, but may be notified up to 3 weeks before departure. The client has the right to cancel the booking if this is done within five days from receiving the notification of the price increase. 12. Late bookings We emphasise the importance of making a booking at the earliest opportunity, because of the small-group nature of the tours. A late booking fee of € 50 should be included with full payment (immediate bank transfer) if booking between nine weeks and 28 days of departure.
These booking conditions supersede any previously published Travelinck conditions. January 2010
